Modern Commons Party Response to Proposed “Stand on Guard” Legislation.
At the Modern Commons Party, we believe that in the unfortunate situation where a person must defend their family or property from an intruder or other aggressive individual, every reasonable action should be on the table. Canadians should never have to worry about being charged or prosecuted simply for acting in defence of their loved ones.
That is why we support the Conservative Party’s proposed Stand on Guard legislation. This law is an important step toward clarifying Canadians’ rights in self-defence situations, ensuring that those defending their homes in good faith are not unfairly prosecuted. It also reaffirms that, as with any criminal charge, the burden of proof lies with the prosecution—preserving the fundamental principle of innocent until proven guilty.
Modern Commons believes every Canadian should feel safe in their own home. While self-defence laws protect individuals in moments of danger, we also recognize that prevention is key. That’s why we support complementary measures, including:
Safer communities through better infrastructure and neighbourhood programs,
Expanded mental health supports to address crises before they escalate into violence.
